Texas Appeals Court Clears Tom DeLay - Again

Opening question: Is there such a thing as triple-jeopardy, outside of game shows hosted by Alex Trebek?:

The highest criminal court in Texas refused Wednesday to reinstate two money-laundering convictions against former U.S. House Majority Leader Tom DeLay, ending a nearly decade-long criminal case against the one-time GOP heavyweight.

The Texas Court of Criminal Appeals upheld a ruling last year from the 3rd Court of Appeals that tossed the Republican's 2010 convictions for money laundering and conspiracy to commit money laundering.

Travis County prosecutors had argued in June before the Austin-based Court of Criminal Appeals that the convictions be reinstated in what they called a scheme to influence Texas state elections.

"Travis County prosecutors" being the Democrat Walking Dead in Armani suits (note the striking resemblance of the arrowed zombie at lower left)....



....who think it should be illegal for Republicans to influence elections, or contest elections, or even breathe outside of solitary confinement in the gulag.

This being Texas, the law still means something there, and the Texas Court of Criminal Appeals didn't exactly concur with the zombies' argument:

"We agree with the court of appeals' ultimate conclusion that, as a matter of law, what the state has proven in this case does not constitute either of the alleged criminal offenses," the high court said in its 8-1 ruling.

Not exactly a split decision.

DeLay, who insists he's not embittered by the nearly-decade long persecution, still is in no doubt about its motivations:

"I understand what it's about and it's about ... the criminalization of politics and the misuse of power ... and prosecutorial misconduct," DeLay said Wednesday from his attorney's office in Houston.

That and his effrontery in being bold, effective, and aggressive in the advancing of a conservative policy agenda (Medicare Part D not withstanding) - or, sans the agenda, exactly how every Democrat operates.  Republicans are not allowed to play by the same rules, which is why Dems are always abusing the courts to turn them into an endless series of one-way streets.
